PROMOTE THE HEALTH AND PHYSICAL DEVELOPMENT OF CHILDREN Essay

How you adapt your practice to meet the health and physical development needs of children, taking into account age, gender, ethnicities, individual needs and abilities In my setting I help to promote children’s health and physical development through daily routines and activities. In all my activities I have in mind that children are individual. I also make use the term â€Å"one size fits all† approach to do my planning. When planning I put into consideration, the age, gender, ethnicities, experience, ability and the specific needs of each child. I aim to give all children in the setting the opportunity to succeed and reach their highest level of personal achievement. I analyse the attainment of different groups of children to ensure that all children are achieving as much as they can. I also make ongoing assessments of each child progress. Other things that I put into consideration to help me achieve my aim are; layout, safety of equipment eg: not too many small piece s, Cleaning rota, flooring-carpet, laminated flooring for easy clean, toys and equipment that challenges children I also consider children cultural/religious practices eg: some clothes worn such as sari’s can be difficult for PE, Adult ratio, dietary needs, training of staff-health and safety, health and hygiene, SchoolSAFE etc., access-are doors suitable for mobility aids. The type of indoor and outdoor activities that will encourage balance, co-ordination, gross and fine motor skills, manipulative skills and hand/eye co-ordination In my setting, I make use of environment and resources. I encourage children of all ages to play together happily because I understand the benefits of different types of play and I help children to experience play that will support their overall development. ACTIVITY BALANCE AND COORDINATION GROSS AND FINE MOTOR SKILLS HAND-EYE COORDINATION Push-and-pull toys, e.g. having dolly in a buggies Climbing, frames, slides Drawing and marks making with crayon, chalks, pencils Jigsaws and puzzles Pretend play i.e making tea, or cooking Self dressing, including buttoning and unbuttoning own clothing Riding bike and scooters Kicking,throwing and catching a ball Dancing and moving to music Walking, Running, jumping and skipping Threading and needling Play dough Computer moving the mouse Water and sand play Cutting with scissor Standing, Hopping In what circumstances you might change routines or activities, how you would adapt existing or planned activities or routines. It is very important to actively plan to meet children’s need because there is otherwise a real danger that some children’s needs might be overlooked, so in my setting I put this into consideration. Activities are usually planned with a group of children in mind, with regards to individual needs. However routines and activities could be changed if the children became bored or I run out of resources. I always have the thought about how an activity could be extended or adapted if needed at the last minute. In my setting all activities and areas of the setting are accessible to all children, there are also sufficient space between furniture and activities that allow free movement around the classroom. What the organisation’s policies and practices are regarding risk assessment and safety and why it is important to follow these? Risk assessment is about being aware of potential dangers in the children’s environment and then taking step to minimise the risk. Risk assessments must be carried out in order to identify hazards and find out the safest way to perform certain tasks and procedures. In my setting, I have a list of what and where to carry out the risk assessment so I carried out this risk assessment every morning. I follow my setting policies and practices regarding risk assessment and safety because it is important to makes my settings safe places for children. What is meant by challenging activities for individual babies and children and the link between challenging activities and developmental progress. How you encourage children to extend their range or skills and achievements. In my setting I always encourage all children of all ages and gender to increase their range or explore the range of their movement and limits of their bodies. This is achieving by: I join the children in some activities  e.g play with ball and making play dough I encourage both boys and girls to join in all activities, individually and together I make sure all children have a go, they take turn I make sure all children have equal access. I give them praise and encouragement when they perform new skill e.g well done or clapping. And at time give them award inform of sticker. K2D293 How to provide opportunities for children to rest and recover from physical activity and why this is important In my setting after physical activity I make sure children have opportunities to have a drink of water Sit down quietly or lie down in the quiet/book corner. This is because they need to catch their breath, slow their heart rates, rest their muscles and generally recharge their batteries. In my setting I also follow a routine that encourages children to relax or rest. It is important for babies, toddlers and young people to rest because it will help the growth and development, and it will help them to relax their brain. How to carry our risk assessment that takes all reasonable precautions without restricting opportunities for development; how organisational policy can support this. The government’s guidelines on healthy eating and nutrition for children and why it is important that these are followed by childcare practitioners As a practitioner it is important to follow the government’s guidelines on healthy eating and nutrition for children, so in my setting as am the one in charge of cooking and preparing snacks for children, I have recently renew my food and hygiene certificate. I make sure that healthy and nutritious food is prepared for the children as I know it is illegal to purposefully contaminated food. The nutritional needs of babies and young children differ according to their age, religion and dietary. There has been a huge amount of research into the problems of childhood obesity- caused by a combination of eating too much especially fatty and sugary food. Lots of snack between meals with little or not enough physical exercise, it has been proven beyond doubt that diet and physical activity in a child’s early years can affect health in later life. There are some guidelines for a healthy diet: Enjoy your food Eat a variety of different foods Eat the right amount to maintain a healthy weight Eat plenty of food rich in starch and fibre Eat plenty of fruit and vegetables Do not eat too many foods that contain a lot of fat Do not have sugary foods and drinks too often In my setting I try as much as possible to follow these guidelines. K2D296 What are appropriate foods to give to children, what foods are unsuitable and why Link to K2D295 K2D297 Special dietary requirements and food preparation, related to culture, ethnicity or religious beliefs In my setting as a child is registered I find out if the child has any specific dietary requirements sot that I can meet the child’s needs whilst still promoting a healthy diet. Children’s dietary requirements are often determined by their family, culture, ethnicity or religious beliefs. Christians may give up certain foods for Lent Jews may not eat pork or shellfish etc. Muslims my breast-fed until the age of two years and may not eat pork or pork products. Sikhs may be vegetarian or eat only chicken, lamb or fish  Hindus may eat no beef or be vegetarian and my drink no alcohol Why it is important that all dietary information is documented and shared with others e.g. food allergies In my setting information about all dietary is documented and shared with other staff in order to avoid any mistake as any mistake made could cause serious harm to the child’s health. Information about children’s allergies to food and drink are regularly updated in my setting. This is always discussed with parents when a child is admitted. How you can encourage healthy eating practices in children In my setting I make children to be aware of healthy foods and how good they are for their bodies. I get them involved in their food as soon as they show an interest. Introduce lots of foods with different tastes and textures East as a group as much as possible, as it will encourage children to enjoy mealtime Introduce children to multicultural healthy foods that are new and interesting Introduce children to exotic fruits and vegetables that are new and interesting Involve children in shopping and preparing healthy foods. Make myself a role model, by drinking water at all time and eating fruit and vegetable also. The need for good oral hygiene and how and why this can be encouraged In my setting, I encourage children to look after their teeth by: Brushing their teeth every morning and night Avoid sweetened drinks at any age Drinking plain water after meals Diet with plenty of calcium, fluoride, vitamins A, C and D and food that need chewing. Regularly visit to the dentist as soon as teeth appear. Principles of cross infection and basic food hygiene In my setting, I make sure children wash their hands, before and after eating, when they go to toilet they washes their hands. As the children washed their hand there is a particular song I thought them, â€Å"This is the way we wash our hands, wash our hands, wash our hands, this is the way we wash our hands all day long. Correct disposal of different types of waste according to procedures and why this is required In my setting, in several occasion I have to dispose of bodily waste like vomit, urine and faeces. I make sure this are disposed of correctly in order to avoid contamination of surfaces and materials that are used to prepare food, or that children work on. I always wear disposable gloves and apron when dealing with waste I make sure I dispose waste promptly and in the appropriate bin. I always wipe surfaces that waste has been in contact with, by using the correct fluids and cloths. I dispose of my gloves and apron and wash my hands thoroughly after dealing with waste Activities that can be undertaken by children to raise awareness of their own bodies and their health needs, according to their age, gender, needs and abilities In my setting I make sure children are aware of their own bodies at the same time teach them how to look after their body to keep them healthy and safe. This is an ongoing process for children because their bodies are changing and developing all the time. Children benefit from understanding that in order to grow and develop their body needs healthy food, water, exercise, rest and to be cared for in a hygienic way. Furthermore all children experience times when they feel unwell. I also provide activities in accordance with children’s age, gender, needs and abilities. Songs singing during circle time involving all the part of the body like ‘head shoulders, knees and toes’†¦.. Having a discussion about the theme ‘All about me’ this encourage children to focus on themselves and their bodies H olding food-tasting events for new healthy food. Pretend play, e.g. doctor and patient Details of health surveillance of children and young people, the role of immunisations and information on regimes for children Heath surveillance can be describe as close supervision or observations that are primarily carried out to detect any problems with a child or young person’s development with the aim of getting them the appropriate support and treatment in future. Child health surveillance should be carried out in partnership with the parent as they are the experts and the best people to identify health, developmental and behavioural problems in their own children. It is a positive experience for parents. In my setting, we always ask parent if they are up-to-date with their children immunisation and further explain to them the important of immunisation. Immunisation is to protect children from diseases that are very serious and could result to death or serious handicaps. It also protects children by preventing diseases from being passed on. How chronic illnesses may affect physical development and how to access further information and support about particular conditions Children with chronic illness may be physical affected. The get tired quickly and so miss out on some activities. I need to keep track of children’s participation in the setting so as to know if they have missed key activities. But children who have chronic illnesses and physical difficulties are given opportunities to join in fully with all discussions and activities. I get support and information from the child’s parent/career as they will be  well informed, I can also search through internet, support groups and health organisation or Libraries.

Operation Zapata

Operation Zapata, or invasion in the Bay of Pigs, was developed by the CIA as a way to replace Castro' s regime by non-communist government friendly to the USA. The initial plan of the operation was revised greatly: â€Å"Kennedy thought the plan exposed the role of the United States too openly† (Sierra, J. A. , 2008). Revised operation had little chances to succeed (Sierra, J. A. , 2008), and several major failures occurred during performance of the invasion (The Bay of Pigs, n. d. ), resulting in failed operation and imprisonment of almost all CIA-trained invading troops.Initial plan was well thought out and had much more chances to succeed, but interference from the new President and his advisors made this impossible to perform and underlined dependence of intelligence agency, its activities and plans from external decisions. Cuban missile crisis was a logical consequence of failed operation Zapata. Castro feared of military interventions from the USA and decided to agree f or placement of Soviet intermediate-range nuclear missiles in Cuba (An Overview of the Crisis, n. d. ) in exchange for training and funding of Cuban army. This activity soon was discovered by CIA (Simkin J., n. d. ). Kennedy ordered a naval blockade of Cuba and demanded USSR to remove all missile bases and their content (Goldman, J. , 1997), and the crisis was launched. Due to efficient performance of intelligence agency critical information about potential enemy activity was obtained beforehand and actions that ensured national security were taken in time. If operation Zapata would be successful, Cuba would have been ruled by the non-antagonist government and USSR would have received no possibilities for the placement of nuclear missiles so close to the US territory.If intelligence had failed to discover Soviet activity on the Cuba, national security would have been endangered greatly because of Soviet nuclear missiles placed so close to the national borders. Speech: Cirque Du Soleil

It was a cold January evening in Las Vegas, Nevada. I was just fourteen with my eighteen year old brother and parents on vacation and celebrating the New Year. My father decided to surprise the family with tickets to a wonderful acrobatic show that was based around the legendary band The Beatles. The show was mesmerizing and absolutely stunning, it in captured my heart and changed me forever. This show was called Love (CHANGE SLIDE) and was run by Cirque du Soleil. Cirque du Soleil is a Canadian entertainment company, self-described as a â€Å"dramatic mix of circus arts and street entertainment. Based in Montreal, Quebec, Canada, (CHANGE SLIDE) and located in the inner-city area of Saint-Michel, it was founded in Gaspe, in 1984 by two former street performers, Guy Laliberte and Gilles Ste-Croix. Initially named Les Echassiers, (CHANGE SLIDE) they toured Quebec in 1980 as a performing troupe and encountered financial hardship. Their financial troubles were relieved by a grant from t heir government as part of the 450th anniversary celebrations of Jacques Cartier's discovery of Canada. CHANGE SLIDE) â€Å"Le Grand Tour du Cirque du Soleil† was a success, and after securing a second year of funding, Laliberte hired Guy Caron from the National Circus School to re-create it as a â€Å"proper circus†. Its theatrical, character-driven approach and the absence of performing animals helped define Cirque du Soleil as the contemporary circus that it remains to be today. Cirque du Soleil traveled throughout Quebec in 1984, appearing in ten cities and playing to audiences of 800 at each performance.The following year, the troupe took its first steps outside its home province and began performing in neighboring Ontario. The audience’s feedback was so positive that it gave Cirque du Soleil even more reason to begin expanding. By 1986, the seating capacity of Cirque du Soleil’s big top tent had been expanded to 1,500, and Cirque du Soleil began to receive national and international attention. The company performed at Vancouver, British Columbia’s Children’s Festival and at Expo ’86, the World’s Fair hosted by Vancouver.Internationally, Cirque du Soleil earned nominations and awards at several competitions and festivals held By the end of 1986, Cirque du Soleil officials were convinced of the concept’s broad-based appeal. Two years after its birth in the small town of Gaspe, Cirque du Soleil’s unique expression of entertainment was ready to make it large. Cirque expanded rapidly through the 1990s and 2000s, going from one show to 19 shows in over 271 cities on every continent except Antarctica. CHANGE SLIDE) Cirque du Soleil employs approximately 4,000 people from over 40 countries and receives estimated annual revenue of more than 810 million dollars. The multiple permanent Las Vegas shows alone play to more than 9,000 people a night, 5% of the city's visitors, adding to the 90 million people who have experienced Cirque worldwide. In 2000, Laliberte bought out Gauthier, and with 95% ownership, has continued to expand the brand. In 2008, Laliberte split 20% of his share equally between two investment groups in Dubai.In partnership with these two groups, Cirque planned to build a residency show in the United Arab Emirates by 2012. However, since Dubai's financial problems in 2008’s global recession, it has been stated by Laliberte it may be looking for another financial partner to continue the company's future plans. Several more shows are in development around the world, along with a television deal, women's clothing line and the possible venture into other mediums such as spas, restaurants and nightclubs. Aside from Cirque du Soleil’s a success sto ry, Cirque du Soleil is far from an easy job. CHANGE SLIDE) Although, the halls are BURSTING with art and colors that the performers create on the side, it takes a lot of time and dedication to be a performer or set technician. A day in the life of a typical Cirque du Soleil performer is a 2-hour rehearsal, 2-hours of doing make up, on your self and than 2 performances. These talented performers will do 8-12 shows 6 days a week. It gets quite repetitive but imagine how exciting it would be to perform for such a large audience every day! If you are under the age 16, you have the same schedule as the other performers but you are also privately tutored in school.The non-performers live a similarly difficult schedule. Long hours of breaking down, setting up and readjusting props six times a week. The shoes are hand crafted and due to so much wear have to constantly be remade. The wigs are designed to fit each performers head perfectly and are fit on to molds of each of them. There is a lot of behind the scenes work that makes each second of the â€Å"magic† in a Cirque du Soleil performance. Surprisingly, Oskar responds to this tragedy by zealously trying to translate his anguish into pragmatic action, into some meaningful search that culminates into something life affirming, a possible resuscitation of the bruised yet indefatigable spirit of modern humanity (Peck 2005). Codification of Law in India

Codification of Law in India Douglas C. North in his book Institutions, Institutional Change, and Economic Performance talks about the importance of institutions, and how these institutions influence economic performance. Institutions include both informal rules  [1]  like code of conducts, traditions and customs and formal rules like constitution, laws and property rights  [2]  . People generally pay attention only to the formal rules that exist in the society and the informal rules dont get the attention and importance that they should get. The British in India did the same thing. But, North argues that these informal rules are also important and they shape the future of the economy. Institutions as defined by North are humanly devised constraints that structure economic, social and political interaction.  [3]   Entry of British in India When the British came to India in 1600s they saw a society which was not governed by any formal laws like the Bible (which was considered to be a divine source of power, law and rules for them) which governed the English; but a heterogeneous society where every individual followed his or her own custom and tradition which were varied. There was no uniformity in the practices that were followed by the people. The concept of formal law like being governed by a uniform system of law or a constitution was an alien concept to the Indians. Kautilya in Arthashastra recognizes existence of four sources of law which are dharma (scriptures), vyavahara (mutual agreement), charitra (local custom) and rajashasana (state decree).  [4]  Kautilya says that these were in ascending order and that the state order prevailed above all the scriptures and customary practices, when a conflict would arise. Similarly even Ashoka and Akbar developed laws which were to be followed by the subjects but they n ever mandated the people to follow these laws unless their customs were such so as to lead to communal disharmony. Thus, we see that the Indians had complete freedom to practice any norm, practice, custom etc. that they pleased as long as harmony was maintained. When the British stayed here as traders they did not interfere into these local customs and practices and were least concerned about it. When they came to the sub-continent the political power was weak as the power of the Mughal Empire in the center was crippling, thus making it easier for the British to gain political control and make a strong foothold in India. The English did gain the central control but their supremacy would only be recognized by the people if they would resolve disputes, which encouraged the British to develop judicial system in India. The law provided the British nothing less than a comprehensive ideology through which to rule.  [5]   The ideology which was used by the British was as Edward Said talks about in his path breaking book Orientalism.  [6]  They made the Indians believe that they were barbaric, uncivilized, in darkness and backward and it was their (British) duty to make the Indians civilized, modern, and progressive and bring them enlightenment. There was cultural hegemony which existed and the British believed that they could improve the Indian situation. The image of the cruel and superstitious natives who needed Christian salvation was deliberately constructed by the Evangelists.  [7]   Informal Institutions in early India and path dependence Initially the British tried administering the practices, norms, culture and traditions that were prevalent in the Indian society, but as there was lack of uniformity as everyone followed different customs and traditions the British found the administration to be difficult. James Mill and Thomas Babington Macaulay wanted to codify the laws in India and wanted to conduct an experiment and see how codified laws worked. They wanted to make the laws based on the principal of utilitarianism and wanted a code which was symmetric in all parts  [8]  and which would bring in uniformity. Thus, began Indias shift from an informal institution where interactions between parties were based on social norms and customs to formal institutions like codified laws. The natives in India for centuries had been following their own local customs and usages.  [9]  The Indians had been travelling on a path where they were not mandated to follow a particular law or text and were free to choose the norm or custom that they wanted to follow. Since there were no restrictions on them the Indians had complete freedom. The Indians had been on this path for a long time and thus there was path dependency.  [10]  This means that since the Indians had been traversing this path for a long time taking an alternative path would be difficult and there would be a high price for changing the path. Another definition of path dependency is that which states that history matters and this affects the possible outcomes in future.  [11]  The change in path in future becomes difficult because of the increasing returns or positive feedback  [12]  that is received because it has been being followed for a long period of time by large number of people. With the idea of the British to bring in formal rules and to codify laws there was a shift in the institution from informal to formal. Shift in the criminal sphere was not difficult as criminal law was universal and was to be applied universally on everyone. Warren Hastings agreed with this codification, but objected to the codification of the personal laws of the Indians as he knew it was dangerous and wanted to stay away from it.  [13]  Since the British could not impose their ideology  [14]  Hastings decided that there would be Indian officials like pandits and maulvis who would help the English judges take decision. Since, the English judges were unaware of the Indian jurisprudence, this help by the officials was essential for them to decide upon cases. Reasons leading to shift in institution from informal to formal The court wanted specific solutions to complex issues. The colonizers did not pay any importance to the existing diversity and would ask questions of general rule and the pandits would answer keeping dharma in mind.  [15]  The answers which the British got were never in tandem with the questions asked, as the pandits and maulvis had never faced such a situation before and the answers differed from one pandit to the other; and these answers were then accepted as general rule of law and were imposed upon the people. Different pandits came to different conclusions even when the circumstances were same because they would refer to different texts or scriptures as there was complete freedom to choose the custom that people wanted to. For example if an Englishman would ask how to turn into a Hindu, the method or the procedure told by different pandits would be different as there was no one particular way of doing it. Thus, there was no uniformity. The pandits in India were not an organization like the Pope of the church. The pandits did not interfere in the political sphere at all; unlike the church where the Pope would coronate the King and then only could he rule. There were varied customs prevailing and every pandit would interpret the text in a different way as there was no single interpretation like there was of the Bible. A well trained pandit would be in a position to cite numerous versus on particular topics or only those that made a particular point useful to a specific scenario or indeed he might express his own opinion on the matter  [16]  but these differed greatly from each other. The customs would change from place to place and the British were baffled at this dissimilar existence of customs. Thus, there was no uniformity and certainty in the decisions given by the pandits and the maulvis. This led to a mistrust of them by the British and hence they decided to codify the law. Another reason for codification of the laws were that they believed that there was popular demand for such changes; and the popular demand according to them consisted of group of elite Hindus who were a part of the British administrative structure itself.  [17]   Organizations acting as change agents North in his book also talks about the existence of organizations which are group of individuals bound together for purpose to achieve objectives  [18]  and are created to take advantage of the opportunities  [19]  that the existing institution provides them and then either work within the existing institutions or change and alter the existing institutions, depending on the objective to be achieved; and hence the organizations which are created out of the existing choice set act as major agents of institutional change.  [20]   When the British realized that administration in India was difficult because of the non-existence of any certain law they finally took the bold step of codifying the personal laws as well. Hastings had wanted to stay away from personal laws as he realized that marriage in India was tied to religion and they had decided on staying neutral towards the native religious affairs and secondly because they thought that there interference might lead to communal violence.  [21]  But the assistance of the pandits and maulvis was now looked at with mistrust and thus, Hastings selected 11 pandits to codify laws which would then be followed by everyone. The pandits came up with Vivadarnavasetu which literally means a bridge on the ocean of disputes was the original Sanskrit version. Later on these were translated in English (with which also there were problems which will be dealt ahead) under the name of A Code of Gentoo Laws. The meaning was totally transformed and words like code and law which were never a part of the original text were now legitimized.  [22]  Then again William Jones appointed Jagannath Tarkapanchanan, the legendary scholar on all branches of the Dharmasastras to compile Vivadabhangarnava which literally means a break wave on the oceans of disputes and it was later translated into English under the title A Digest of Hindu Law. Again the importation of British concepts of digest and law were used to legitimize the transformation of the prescriptive guidelines in the Sastras as legal rules to be administered by the court.  [23]   Initially the British gave regard to the customs that were ubiquitous while codifying the laws,  [24]  but even then they realized that there were uncertainties and they could not trust the Indian officials as there was a possibility of them defrauding the company for their own benefits.  [25]  Thus, many English jurists like William Jones, Colebrooke decided to translate the texts into English so that the judges could use it. But the translations were done by European scholars. When translations were done the essential meanings got lost and the entire meaning and its essence could not be understood and translated, as there are certain words the exact word for which might not exist in the other language. For example the word dharma which means the all en-compassing duty to do the right thing at the right time, at any point of ones life, was simply translated as law.  [26]   The English jurists who translated the texts into English were the organization which objected to the existing informal institution. This organization had the common objective (having political control over India) was the ease of administering laws. The goal which the organization sought to achieve of uniformity and stability could not be achieved with the existing institution of informal norms, code of conduct and behavior; they had to get in something more concrete like formal laws so that there could be certainty and uniformity. This organization emerged because of the existing choice set which was available to them because of the informal rules in place and they took advantage of the position that they had attained and acted as change agents or as North would call them entrepreneurs in economic terms and gave India codified laws. Importance of informal norms North in his book also states that move from informal to formal institutions is a slow process.  [27]  Although formal rules may change overnight due to political or judicial decisions, informal constraints embodied in customs are much more impervious to deliberate policies. These cultural constraints not only connect the past with the present and the future, but provide us with a key to explaining the path of historical change.  [28]   In India if we see the move from informal non-codified laws to formal codified laws was a slow process as the British initially tried to administer the informal rules only, but when the result was not to their satisfaction they decided to move towards codified formal rules. But, if seen from another perspective then we see that the change was all of a sudden as the British imposed these codified laws on the Indians when for a long time they had been following a different path altogether. This imposition of the laws on the Indians could not percolate into the society and could not become a part of the society easily as these were imposed from outside and were not from within the society itself and sometimes were not in conformity with the existing norms. Change from informal to formal institution has a cost Transaction Cost Now this institutional change from informal to formal could not be without any cost. There was a cost which the society had to bear, but this cost was not taken into consideration when the organization was taking the decision of altering the institutions according to its own benefit. The cost borne was the change of many customs that were existing, loss of many customs as they were not codified, freezing of identities, creeping in of foreign ideologies and biasness and death of plurality of customs, traditions and indigenous practices. This cost is known as transaction cost as it is the cost of changing the path upon which one has been travelling for a long period of time (non-codified laws) to a new path (codified laws). Transaction cost is a result of the institutional change, but this transaction cost also could have brought in Indians a feeling of unity which had not existed before within a group and also led to the abolishment of many evil practices that were being practiced by the people. Codification of Hindu law was a humongous task because there was no existence of anything called the Hindu law (its existence was presumed by the British keeping in mind the bible which was their source of law) prior to the colonial era, and secondly because what the British mistook to be the source of Hindu law was so vast that they were unable to codify everything as there were various norms being followed in the society which did not come from some ancient scriptures or religious texts. In England there existed a homogenous society with everyone following what the church told them and as already mentioned above the church was an organization and hence their interpretations of the bible (which was the divine source of their law) were also same. So when the English came to India they came with a framework in their mind that, there would be a homogenous society and that this homogenous society would have a divine source of law. But, the British were in for a surprise when they came t o India. They realized that a heterogeneous society with various different practices existed in India and they failed to find a divine source of law; but were adamant on finding a source of law something which was akin to the cannon law and hence in their desperate attempt to find a source, William Jones who was to then translate the sources of law in to English considered Manusmriti which were the Memories of Manu to be the source of law and the translation came to be known as the Institutes of Hindu Law.  [29]  India does not have a cannon law which legitimizes a uniform code for all the diverse groups of the community; but, because of this arbitrariness the British started patronizing education and interpretation of the shastras for their own.  [30]   The British thought that they would derive the law from the texts and scriptures but this task was cumbersome and impractical. They were influenced a lot by the legal theory especially that of Jeremy Bentham.  [31]  Bentham believed in the principle of utilitarianism. Utilitarianism means greatest good for the maximum number of people. In such a scenario it is the minority that is left out and their needs are not taken into consideration; but while codifying these laws the opposite happened. Codification of these laws was done by few pandits who had their own interpretation of the texts and it was done on the demand of a few people with whom the British interacted. Thus, what got codified were just a few traditions and customs and a large number of them were left out and hence got lost. There was strong impact when colonial law encountered the personal law. It led to customs like property rights which are important for the development of any society being substantially altered in Bengal and rights of women to hold property was also substantially changed.  [32]  There were two schools of thought that existed in India Mitakshara and Dayabhag with regards to property rights. Mitakshara was followed everywhere except in Bengal where Dayabhag school of thought was followed. When codification was done by William Jones he was influenced by the Dayabhag School and hence, most of their beliefs got codified and beliefs of the other school were left out leading to the death of many customs. The loss of customs was not only because they were not codified, but also because the judges refused to recognize the existing norms if they did not have any spiritual authority. Customs that the people followed were something which had been developed by the community on their own and h ad no spiritual backing and hence they were considered invalid by the courts. When there was a conflict between customary law and the official law, then the customary law had to be established and then only would the customary law prevail. But the standard set for proving customary law was so high that hardly any law could meet the requirements and slowly all of them withered away.  [33]  The judges also had the power to strike down the law on the basis that they considered it to be against public policy. There was no definition given as to what was against public policy and this gave unfettered power in the hands of the judge to decide which laws were valid and which were against public policy.  [34]   There was freezing of identities as Hindus were now considered to be a larger group of people and were considered to be a community while on the other hand the Muslims were considered outsiders.  [35]  This also happened because in courts the judges had to apply Hindu law to the Hindus and the Muslim laws to the Muslims; so now the people had to decide which religious community they belonged to, whereas initially there was no such pressure on them to identify themselves with a particular religion and were free to choose any custom of any religion they wanted to follow. The translation of the code was done by English jurists who were trained in English laws and customs. So when they translated the law they could not keep aside their biasness and facets of English law crept in. Thus, the new law which came into being comprised of first, the interpretation of the laws by the judges, in the form of case laws acting as precedents and secondly, through codification of the scriptures. T hey also used the principles of justice, equity and good conscience while deciding the cases. This led to the emergence of Anglo Hindu law.  [36]   As Anderson in Islamic Law says  [37]  : the construction of Hindu law in India by the British colonial government [and] the British effort to find Hindu lawà ¢Ã¢â€š ¬Ã‚ ¦assumed that the Hindu law would be found thoughà ¢Ã¢â€š ¬Ã‚ ¦deduction from precedent and a focus on cases. Hindu law gradually came to be based on previous judges decisions, not on Hindu sacred texts. These texts themselves were mistranslated and selected according to the conceptions of English civil law, so that Hindu law was ultimately defined in terms of European conceptions of Hindu law. But the transaction cost borne also helped as this death of plurality led to removal of many practices that were evil and were rampantly practiced in the society. Various acts were passed which made the social condition better, like the Sati regulation of 1829, the Caste Disabilities Removal Act 1850, the Hindu Women Remarriage Act 1856, and Child Marriage Restraint Act of 1929. The Pentangle Essay -- Literary Analysis, Gawain, The Green Knight

In the anonymous poem Sir Gawain and the Green Knight, the character of Sir Gawain is portrayed as the imperfect hero. His flaws create interest and intrigue. Such qualities of imperfection cannot be found in the symbol of the pentangle, which he displays on his shield. This contrast between character and symbol is exposed a number of times throughout the poem allowing human qualities to emerge from Gawain’s knightly portrayal. The expectations the pentangle presents proves too much for Gawain as he falls victim to black magic, strays from God, is seduced by an adulterous woman, and ultimately breaks the chivalric code by lying to the Green Knight. The pentangle, also called the â€Å"endless knot,† (630) is a five-pointed star enclosed in a circle, worn as an amulet to â€Å"avert evil from or bring fortune to the wearer† (Talisman, OED). Writer Eliphas Levi says that when the pentangle is pointing up it represents spiritual dominance over the material. Presented the other way, the physical world rules over the spiritual -often associated with dark magic (Pentagram, Wikipedia). This parallel foreshadows the trickery played on Sir Gawain by the Green Knight. The Green Knight challenges Gawain to a â€Å"Christmas game† (283) in an attempt to humble Gawain, tempting him with worldly pleasures and proving that even the greatest of knights are not perfect. Upon finding the Green Chapel, Gawain suggests that â€Å"Here might / The devil himself be seen / †¦at black midnight† (2186-8). Comparing the Green Knight to the devil proves accurate because at the end of the play, the Green Knight confess es that â€Å"the count of your kisses and your conduct too, / And the wooing of my wife—it was all my scheme!† (2360-1). Describing the midnight as â€Å"black† (... ...ain as an imperfect hero makes him an interesting character and allows the reader to see his human qualities emerge in a moralistic story. The tension between two sides of a character trait is represented through contrast with the perfection of the pentangle symbol. God and material possession, fidelity and seduction, and knight and human are all parallel to the two interconnecting triangles depicted in the pentangle. It is impossible to have one without the other. The interconnectedness of our senses, our bodies, our spirituality, our love and emotions, and our personality create a pentangle, binded by a circle: life. The pentangle perhaps places too high an expectation on perfection and does not allow room for human flaws. Such flaws lead to the downfall of Sir Gawain because he was unable to live up to the expectations of the symbol displayed on his shield.

However, there are many similar parts that go into creating every person’s identity. Of course, there is the biology, the genetics. Then there are outside forces, the nurturing of a person. When trying to form an identity, there are numerous outside factors that contribute, such as gender, culture, and environment.For Marji, the protagonist of the Persepolis series, being an Iranian woman is absolutely a factor that featured prominently in the shaping of her personality. She was not allowed to experiment with her identity by her clothing or style, because the government controlled what women were allowed to wear. She had to have some sort of connection with religion, because the government forced the religion upon its subjects. She also experienced hardships, like the death of family members, beca use of war against the tyrannical government.Growing up under the oppressive hand of the Iranian government has formed Marji’s strong identity. Clothing, a big form of self-expression, was predetermined for Marji, so that she had a few options of how to proceed. The first thing Marji introduces in the story is the veil, which is a headscarf that women are required to wear for public decency. Marji does not like the veil since she does not understand why she has to wear it. When Marji is young, she says, â€Å"I really didn’t know what to think about the veil, deep down I was very religious† (Persepolis 1, 7). Since she is so young, she is unaware of the real point of the veil.It is forced on because the government wants to hide the potential power women have. Later, Marji finds out that the restricted clothing has constrained her freedom by not allowing her to express a part of her individuality. After her parents come back from a trip to Istanbul, Turkey, she g ets gifts such as 1983 Nike Shoes, a denim jacket, a Michael Jackson button, and posters. She puts on her new shoes and her new jacket with the new button on it to go out and buy some music tapes. However, the guardians of the revolution, the women’s branch who arrest women who are improperly veiled, catch Marji.She luckily gets away. Through this experience, she realizes that she does not even have a minimal amount of freedom to show her individuality as a rebel. Clothing allows people to express their individuality, but forcing women to wear the veil not only prevents women from showing their own personality but also eliminates their freedom. If a woman wears a veil, then all the women will look just the same, and there is no opportunity for individuality there. Marji travels to Europe, and while there, she is finally able to express herself and experiment with her personality.When Marji becomes sixteen, she tries new stuff, coating her hair with gel, adding a thick line of eyeliner, and using safety pins as earrings (Persepolis 2, 36). As you see in the panels, she experiments with her hairstyles, which would not even be seen under the oppressive Iranian regime. Each new style is in a completely separate panel, showing the time passing between each event (McCloud 101). It takes time to develop an identity. She is allowed to express herself in Europe, and because of this, she is able to develop her personality in a way that she could not have been able to if she had been back in Iran.The government keeps Iranian women on a tight leash, so the lack of expression through clothing that Marji experiences in Iran, and the amount of expression she experiments with outside of her country, helped her develop as a person. Iran has a very strong connection between religion and state, which is reflected in Marji’s spirituality. Marji says herself that she was born with a religion, and she believes her path is to be a prophet. Religion becomes a part of he r character. Because she wants to be a prophet when she is ten, God sometimes appears and becomes her companion.Whenever Marji is having a personal conflict, God appears to help her work through it. For example, Marji takes a long bath in the water tub to feel like to be in a cell filled with water, when God appears to her. She is trying to experience what it feels like to be tortured, like her captured relatives and countrymen. God just randomly appears to her to ask, â€Å"What are you doing? † (Persepolis 1, 25). In that panel, The main color is white. White is a color like purity and spirituality, which makes sense, because God is in it. However, in the next panel, the background is entirely black.This panel does not have God in it. Instead, it is just Marji almost connecting to the pains of her grandfather. So the simplicity of the black background helps show the beginning of her internal conflict (McCloud 192). Marji is learning about how cruel the government truly is, and even God cannot help her understand why. Because Iran was very connected to religion, she always has a spirituality about her. The government forced a certain religion on Marji. Even though she did not always believe in that religion, she was still shaped by her conversations with God.Even though God doesn’t appear later on, believing in a religion as a child was able to lay the foundation for a spirituality that would last her the rest of her life. Living through war is very difficult. Because of war, many of Marji’s families and her neighbors met death. Satrapi’s graphic style, which is mainly composed of black and white, depicts violent moments with a simple description. For instance, when Satrapi depicts the bombing of her neighbors, the black and white frames, along with the gutters, portrays how terrified Marji feels (Persepolis 1, 142). For example, there is a panel where Marji is covering her eyes.Then it cuts to a panel that is just completely black . It shows just how emotional the scene is (McCloud 150). Because Satrapi’s style is so simple, drawing the character to explain the horrible emotions would be out of style. It is much more expressive just to keep the panel completely black. Since those dreadful incidents happened to her when she was young, she grew up as a strong-hearted and caring Iranian who knew the difficulties of war and came out stronger for it. Even though she disagrees with the lack of freedoms in her country, she is very proud to be an Iranian woman.She actually says this when some students were talking at a restaurant and were not respecting her. She stood up and said to them, â€Å"You are going to shut up or I am going to make you! I AM IRANIAN AND PROUD OF IT† (Persepolis 2, 43). The war and demonstrations due to the revolution has built her a strong identity as an Iranian. Marji is definitely shaped by her outside environment. The fact that she is Iranian during such difficult times is a bsolutely a big environmental factor. Not being able to wear whatever she wants limits her self-expression, so she has to work around that. The government forces a religion on her.She is also thrown into the middle of a war. All of these things should limit how her identity grows. But despite all the obstacles that being Iranian created for her, in the end, she still has a very strong connection with her Iranian culture.
